[Case Summary]
The special procedures for security interest realization newly added in China's Civil Procedure Law aim to realize a mortgager's security interests in a simpler way protect the interests of a creditor and realize security interests in a non-litigation manner. Thus where both an obligor and an obligee fail to reach an agreement on the realization of security interests the security interest holder and other persons entitled to request the realization of the security interests may directly apply to the court for auction or sale of the security property. It is not necessary for such parties to realize the security right through litigation. An objection to jurisdiction means that a litigant may raise an opinion or claim of dissatisfaction with the jurisdiction to the court accepting the lawsuit or the court that the case was transferred to when he believes the court has jurisdiction over the case. 江蘇南京鼓樓法院裁定國信擔保公司對朱松年實現擔保物權案


 ——民訴法新增實現擔保物權特別程序的適用 
 裁判要旨

 實現不動產擔保物權特別程序具有非訟性,管轄異議等訴訟案件中的程序規定不應適用。如抵押房產未設定在先抵押,擔保的債權確定,擔保物權實現條件成就的證明材料齊備,即可裁定對抵押財產進行拍賣或變賣。不符合法律規定的,則裁定駁回申請。
 案情
 2011年11月22日,交行江蘇分行與南京銀碩科技實業有限公司(簡稱銀碩公司)簽訂借款合同一份,約定銀碩公司向交行江蘇分行借款600萬元。交行江蘇分行與江蘇省國信信用擔保有限公司(簡稱國信擔保公司)簽訂保證合同一份,約定國信擔保公司為上述借款提供連帶保證責任。銀碩公司與國信擔保公司簽訂委托擔保合同一份,約定:國信擔保公司為上述借款提供擔保,銀碩公司將多名第三人所有的南京市白下區健康路251號3單元911室、白下區致和新村6幢306室、鼓樓區中山北路283號6號樓503室、雨花臺區共青團路三村2幢507室等四處房產設為抵押物,向國信擔保公司提供反擔保。合同簽訂后,交行江蘇分行按約放貸。2012年1月13日,國信擔保公司與朱松年簽訂抵押合同一份,約定:朱松年將其鼓樓區中山北路283號6號樓503室房產為反擔保抵押物,為主合同中的74萬元提供擔保,并辦理了抵押登記,該房產未設定其他在先抵押。因銀碩公司未按約還貸,國信擔保公司為其代償貸款本息6211560元。國信擔保公司索要代墊款項未果,遂訴至法院,申請拍賣或變賣被申請人朱松年所有房產所得價款優先受償。
 裁判
 江蘇省南京市鼓樓區人民法院經審理認為,案涉借款合同、委托擔保合同、抵押合同合法有效。朱松年以其房產為反擔保抵押物,并辦理了登記,擔保金額為74萬元,且該房產沒有設定其他在先抵押。國信擔保公司已依約代銀碩公司償還銀行借款,有權就反擔保抵押房產優先受償。
 2013年3月15日,法院裁定:準予拍賣、變賣被申請人朱松年所有的房產,申請人國信擔保公司對所得款項在74萬元范圍內優先受償。本裁定為終審裁定。
